These Terms of Service ("Terms") govern your access to and use of www.kamanai.co, including all content, features, products, purchases, and services offered through the website.

The website is owned and operated by Kamanai LLC, a New Jersey limited liability company ("Kamanai," "we," "us," or "our").

By visiting the website, submitting information, or purchasing a product, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.

1. Eligibility

You must be legally capable of entering into a binding agreement to use the website or purchase products.

If you are under the age of majority where you live, you may use the website only with the involvement and permission of a parent or legal guardian.

By using the website, you represent that:

2. Website Use

Kamanai grants you a limited, revocable, nonexclusive, nontransferable license to access and use the website for personal, noncommercial shopping purposes.

We make reasonable efforts to display product descriptions, materials, measurements, colors, images, and other information accurately.

Colors may appear differently depending on your screen, lighting, and device settings
Garment measurements may vary slightly because of manufacturing tolerances
Placement, texture, distressing, stitching, and finishing may vary slightly between items
Product packaging may differ from website images
Website content may contain typographical, pricing, or technical errors

Nothing on the website guarantees that a product will look exactly the same on every device or person.

Kamanai may correct errors and update product information at any time.

4. Availability and Purchase Limits

All products are subject to availability. Placing an item in your shopping cart does not reserve it.

We may:

Limit quantities per person, household, payment method, address, or order
Restrict purchases of limited-release merchandise
Decline orders suspected of resale, fraud, abuse, or unauthorized use
Discontinue products without notice
Correct inventory errors
Cancel an order if an item becomes unavailable

If we cancel a paid order, we will issue a refund for the canceled product to the original payment method.

Your submission of an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we received the order but does not necessarily mean that we accepted it.

Payments may be processed through Stripe or another third-party payment processor. Your use of a payment method may also be governed by the provider's terms and privacy policy.

You represent that:

You are authorized to use the selected payment method
The payment information is accurate
You authorize the applicable charges, taxes, shipping fees, and other disclosed amounts

We are not responsible for charges imposed independently by your bank, card issuer, payment provider, customs authority, or currency-conversion provider.

7. Taxes

Applicable sales, use, excise, value-added, or similar taxes may be calculated and collected at checkout based on the order, delivery destination, and applicable law.

You are responsible for taxes, duties, or governmental charges not collected by Kamanai where applicable.

8. Promotional Codes and Offers

Promotional codes, discounts, credits, and special offers:

Are subject to the terms communicated with the offer
May have expiration dates
May apply only to eligible products or customers
May not be combined unless expressly stated
Have no cash value
May not be sold or transferred
May be revoked if obtained or used through fraud, abuse, or error

We may modify or cancel a promotion where permitted by law.

9. Shipping and Delivery

Kamanai ships worldwide. Shipping dates and delivery estimates are estimates, not guarantees, and may vary significantly depending on the destination.

Delivery may be affected by:

Carrier delays
Weather
Holidays
Customs processing
Incorrect or incomplete addresses
High order volume
Events outside our reasonable control

You are responsible for providing a complete and accurate delivery address, including any information required for international delivery (such as a postal code, province/state, or customs identification number where applicable). Contact us promptly if you identify an address error. We cannot guarantee that an address can be changed after an order enters fulfillment.

Risk of loss and title transfer as provided under applicable law and the shipping terms disclosed during checkout.

Kamanai is not responsible for a delay caused by a carrier or an event outside our reasonable control. We will, however, provide reasonable assistance with eligible carrier claims.

Additional shipping charges may apply when a package is returned because of an incorrect address, refusal, failed delivery, or failure to collect the package.

10. International Orders

Because we ship worldwide, international orders may be subject to:

Customs inspections
Import duties
Taxes
Brokerage charges
Carrier fees
Delivery restrictions
Delays

Unless checkout expressly states otherwise, the recipient is responsible for all import duties, taxes, and customs or brokerage charges imposed by the destination country. These charges are collected by the carrier or customs authority, are outside Kamanai's control, and are not included in the displayed product or shipping price.

We do not guarantee that every product can legally be shipped to or imported into every jurisdiction. We may decline or cancel an international order where shipping is unavailable, restricted, or prohibited by the destination country's law. If we cancel an order for this reason, we will refund the amount paid to Kamanai, excluding any nonrefundable third-party fees already incurred.

11. Returns, Exchanges, and Refunds

Returns, exchanges, refunds, and final-sale restrictions are governed by the Return Policy displayed on the Kamanai website at the time of purchase.

You are responsible for reviewing the Return Policy before completing an order.

Unless applicable law requires otherwise:

Products must satisfy the stated eligibility requirements
Return requests must be submitted within the stated return period
Products marked "final sale" are not eligible for return or exchange
Shipping charges may be nonrefundable
Original and return shipping costs may be deducted where disclosed
Refunds may be issued only after the returned product is received and inspected
Refunds are generally made to the original payment method
Processing times may vary depending on the payment provider

International customers should note that return shipping costs, customs fees, and processing times for returns sent from outside the United States may be greater than domestic returns; see the Return Policy for details.

Nothing in these Terms limits a nonwaivable consumer right available under applicable law.

12. Damaged, Defective, or Incorrect Products

Inspect your order promptly after delivery.

If a product arrives damaged, defective, or materially different from what you ordered, contact contact.kamanai@gmail.com within the period stated in our Return Policy.

Include:

A description of the issue
Clear photographs of the product
Photographs of the packaging when relevant

Do not discard the product or packaging until we respond. Depending on the circumstances and applicable law, we may offer a replacement, exchange, repair, store credit, or refund.

Normal wear, misuse, improper laundering, accidental damage, unauthorized alterations, and failure to follow care instructions are not manufacturing defects.

13. Product Care

You are responsible for reviewing and following the care label and product-care instructions.

Unless a product states otherwise, printed garments may require special care, including washing inside out, using cold water, avoiding bleach, tumble drying on low, and avoiding direct ironing over printed areas.

Kamanai is not responsible for damage caused by care that conflicts with the garment label or published instructions.

14. Communications

By providing your contact information in connection with an order, you consent to receive transactional communications about:

Payment
Order confirmation
Fraud review
Fulfillment
Delivery
Returns
Refunds
Customer support
Changes affecting your transaction

Transactional communications are not marketing messages.

When you separately subscribe to marketing communications, you consent to receive promotional emails from Kamanai. You may unsubscribe through the link included in a marketing email.

Your consent to receive marketing communications is not a condition of purchasing a product.

15. Contact Submissions and Feedback

When you send suggestions, ideas, feedback, reviews, photographs, or other nonconfidential material to Kamanai, you represent that you have the right to provide it.

Unless we separately agree otherwise in writing, you grant Kamanai a worldwide, nonexclusive, royalty-free license to use, reproduce, adapt, publish, and display voluntarily submitted feedback for legitimate business purposes.

This section does not transfer ownership of private customer-service communications or personal information. Personal information remains governed by our Privacy Policy.

Do not send trade secrets, confidential business information, or content you do not have permission to share.

16. Intellectual Property

The website and its contents are owned by Kamanai or used under license and are protected by intellectual-property laws.

No right to use a Kamanai trademark, logo, artwork, trade dress, or other brand element is granted by implication.

17. Third-Party Services and Links

The website may rely on or link to third-party services, including payment processors, shipping carriers, social-media services, and analytics providers.

Kamanai does not control and is not responsible for a third party's:

Your use of a third-party service is governed by that provider's policies and agreements.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE."

KAMANAI DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE
DEFECTS WILL ALWAYS BE CORRECTED

PRODUCT INFORMATION WILL NEVER CONTAIN AN ERROR

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

Nothing in this section excludes an express product commitment made by Kamanai or a warranty that cannot legally be disclaimed.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAMANAI LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST BUSINESS, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO THE WEBSITE, PRODUCTS, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAMANAI'S TOTAL LIABILITY FOR A CLAIM RELATING TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID KAMANAI FOR THE PRODUCT GIVING RISE TO THE CLAIM.

FOR OTHER CLAIMS, KAMANAI'S TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID KAMANAI DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
ONE HUNDRED U.S. DOLLARS.

These limitations do not apply to liability that cannot legally be limited, including liability where an exclusion would violate applicable consumer law.

21. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Kamanai LLC and its members, managers, employees, contractors, agents, affiliates, licensors, and service providers from claims, liabilities, losses, damages, judgments, costs, and reasonable attorneys' fees arising out of:

Your unlawful use of the website
Your material violation of these Terms
Your infringement of another party's rights
Content you submit without authorization
Fraudulent or unauthorized conduct attributable to you

This section does not require a consumer to indemnify Kamanai for Kamanai's own unlawful conduct, negligence, or breach where such an obligation would be prohibited by law.

22. Force Majeure

Kamanai will not be liable for a delay or failure caused by circumstances beyond our reasonable control, including:

Natural disasters
Severe weather
Fire or flood
Epidemics or public-health emergencies
War, terrorism, or civil unrest
Government action
Labor disputes
Carrier interruptions
Utility or internet outages
Cyberattacks
Supplier or manufacturing interruptions
Payment-network failures

We will make commercially reasonable efforts to resume affected operations.

23. Governing Law

These Terms and disputes relating to them are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.

This choice of law does not deprive you of any mandatory consumer protection provided by the law of your state or country of residence.

24. Dispute Resolution and Venue

Before filing a lawsuit, you and Kamanai agree to make a good-faith effort to resolve the dispute informally.

If the dispute is not resolved informally, either party may pursue available legal remedies.

To the extent permitted by law, a legal proceeding must be brought in a state or federal court with appropriate jurisdiction in New Jersey. You and Kamanai consent to the personal jurisdiction of those courts.

This section does not prevent either party from bringing an eligible matter in small- claims court or seeking emergency injunctive relief. It also does not override a consumer's nonwaivable right to bring a claim in another forum.

25. Changes to the Website or These Terms

We may modify the website, products, policies, and these Terms periodically.

When these Terms change, we will update the "Last Updated" date. Material changes may also be communicated through the website or another appropriate method.

Changes apply prospectively from their effective date unless applicable law requires otherwise.

Your continued use of the website after revised Terms take effect constitutes acceptance of those revised Terms.

26. Suspension and Termination

We may suspend or terminate access to the website if we reasonably believe you:

Violated these Terms
Engaged in fraud or unauthorized activity
Created a security risk
Abused a promotion or purchasing restriction
Used the website unlawfully

Terms that by their nature should survive termination will remain effective, including provisions concerning intellectual property, disclaimers, liability, indemnification, disputes, and governing law.

The remaining provisions will remain in effect.

Kamanai's failure to enforce a provision of these Terms is not a waiver of that provision or the right to enforce it later.

A waiver is effective only if it is in writing and authorized by Kamanai.

29. Assignment

You may not assign or transfer your rights or obligations under these Terms without Kamanai's written consent.

Kamanai may assign these Terms as part of a merger, reorganization, financing, asset transfer, acquisition, or sale of the business, subject to applicable law.

30. Entire Agreement

These Terms, the Privacy Policy, the Return Policy, and any additional terms presented during checkout constitute the entire agreement between you and Kamanai regarding the website and purchases.

If additional terms conflict with these Terms, the more specific terms govern the relevant transaction or feature.
