These providers may process information only for the services they provide to us, subject to their agreements and applicable law.
B. Advertising and Analytics Partners
We may use advertising and analytics technologies, such as Google Analytics or the Meta Pixel. These providers may receive device, browser, activity, purchase, and conversion information through cookies, pixels, or similar technologies.
Kamanai does not sell personal information for money. However, certain state privacy laws (see Section 9) define some advertising-related disclosures — such as sharing information with ad platforms for retargeting — as "sharing," "selling," or "targeted advertising," even when no money changes hands. Where this applies to you, you can opt out through the methods described in Section 8 and Section 10.
C. Legal and Safety Disclosures
We may disclose information when we reasonably believe disclosure is necessary to:
- Comply with applicable law, regulation, subpoena, court order, or legal process
- Respond to a lawful government request
- Investigate fraud, abuse, security incidents, or suspected illegal conduct
- Enforce our Terms of Service or other agreements
- Protect the rights, property, health, or safety of Kamanai, our customers, or others
D. Business Transactions
If Kamanai is involved in a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar business transaction, information may be disclosed or transferred as part of that transaction.
E. With Your Direction or Consent
We may disclose information to another party when you direct us to do so or provide your consent.
4. Cookies and Similar Technologies
We and our providers may use cookies and similar technologies to:
- Keep the website functioning
- Preserve shopping-cart contents
- Remember user preferences
- Secure transactions
- Analyze website activity
- Diagnose technical problems
- Measure marketing performance
- Personalize content or advertising
Cookies generally fall into three categories:
- Essential cookies — required for the website and checkout to function; these cannot be disabled through our cookie tool.
- Analytics cookies — help us understand how visitors use the site (e.g., Google Analytics).
- Advertising cookies — used to deliver and measure ads (e.g., Meta Pixel).
Where required by law, we will request your consent before setting nonessential cookies, and you can change your preferences at any time through the cookie-preference tool on our website or your browser settings. Disabling cookies may prevent certain website features, including checkout, from functioning correctly.
5. Email and Marketing Communications
When you subscribe to Kamanai marketing communications, we may use your email address and related engagement information to send:
- Product-release announcements
- Restock notices
- Promotional offers
- Brand news
- Event information
- Other marketing communications
You may unsubscribe at any time by selecting the unsubscribe link in a marketing email. You may also contact us at contact.kamanai@gmail.com.
Unsubscribing from marketing emails will not stop operational communications relating to an order, payment, delivery, return, account, legal notice, or customer-service request.
We do not authorize third parties to add you to Kamanai's marketing list without appropriate permission.
6. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this policy. As general guidance:
- Order and transaction records are typically retained for at least as long as required by applicable tax and accounting laws (often 5–7 years).
- Marketing and email engagement data is retained until you unsubscribe or your contact record becomes inactive, and then deleted or anonymized within a reasonable period thereafter.
- Customer-service correspondence is retained for a period sufficient to resolve the matter and address any follow-up or dispute.
- Automatically collected website/analytics data is generally retained according to the retention settings of the analytics tool in use (e.g., Google Analytics' default retention windows), unless a shorter period is selected.
When information is no longer reasonably necessary for these purposes, we delete, anonymize, or securely dispose of it.
7. Data Security
We use reasonable administrative, technical, and organizational measures intended to protect personal information from unauthorized access, loss, misuse, alteration, and disclosure.
However, no website, internet transmission, storage system, or security measure is completely secure. We cannot guarantee absolute security.
You are responsible for using secure networks and protecting any device or account credentials used to interact with our website. In the event of a security incident affecting your personal information, we will notify affected individuals and any required regulators as required by applicable law.
8. Your Privacy Choices
Depending on where you live, you may have the right to request that we:
- Confirm whether we process your personal information
- Provide access to personal information we maintain about you
- Correct inaccurate personal information
- Delete certain personal information
- Provide a portable copy of certain information
- Limit or object to certain processing
- Opt out of targeted advertising
- Opt out of certain sales or sharing of personal information
- Withdraw consent when processing is based on consent
- Appeal a decision concerning a privacy request
These rights are not absolute and may be subject to legal exceptions. For example, we may retain information needed to complete a transaction, prevent fraud, comply with tax obligations, establish legal claims, or meet another lawful requirement.
To submit a privacy request, email contact.kamanai@gmail.com with the subject line "Privacy Request."
Please include:
- Your full name
- The email address associated with your interaction or order
- The right you wish to exercise
- Sufficient information for us to identify the relevant records
We may need to verify your identity before completing a request. We will use information supplied for verification only to process and document the request, and typically aim to respond within the timeframe required by applicable law (commonly 45 days, with a possible extension).
Where applicable, an authorized agent may submit a request on your behalf. We may request evidence of the agent's authority and may ask you to verify your identity directly.
We will not unlawfully discriminate against you (e.g., by denying service, charging different prices, or providing a different quality of service) for exercising an applicable privacy right.
9. State-Specific Privacy Disclosures
Residents of certain U.S. states — including but not limited to California, Colorado, Connecticut, Virginia, and other states with comprehensive consumer privacy laws — may have additional rights under applicable state law, as described in Section 8.
Depending on the law and our activities, categories of information we may collect include:
- Identifiers
- Customer-record information
- Commercial and transaction information
- Internet or electronic-network activity
- Approximate geolocation information
- Inferences based on interactions with our website
- Communications submitted to customer service
We collect and use these categories for the business and commercial purposes described in Section 2.
We do not knowingly sell personal information for money. Our use of analytics or advertising technologies may qualify as "sharing," "selling," or "targeted advertising" under certain state laws. Where legally required, you can opt out using the Global Privacy Control signal described in Section 10, or by emailing us at the address in Section 8.
We do not knowingly use or disclose sensitive personal information for purposes other than those permitted by applicable law, and we do not knowingly sell or share the personal information of consumers we know to be under 16 years old without the opt-in consent required by applicable law.
Note: Some state privacy laws apply only to businesses that meet certain revenue or data-volume thresholds. This section is included for completeness; whether it applies in full to your business should be confirmed with counsel.
10. Do Not Track and Global Privacy Signals
Some browsers transmit "Do Not Track" signals. Because there is no universally accepted standard for responding to all such signals, our website may not respond to every Do Not Track setting.
Where required by applicable law and technically supported, we will process recognized browser-based opt-out preference signals, such as the Global Privacy Control (GPC), as a request to opt out of sale/sharing or targeted advertising for the browser or device sending the signal.
11. Children's Privacy
The Kamanai website is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13. If you believe a child under 13 has provided personal information to us, contact contact.kamanai@gmail.com so we can investigate and take appropriate action.
Individuals under the age of majority in their jurisdiction should use the website only with the involvement and permission of a parent or legal guardian.
12. Third-Party Websites and Services
Our website may contain links to third-party websites, social-media platforms, payment services, or other services that Kamanai does not control.
This Privacy Policy does not govern third-party services. We are not responsible for their privacy, security, content, or business practices. Review the applicable third party's policies before providing information.
13. International Visitors and Cross-Border Transfers
Kamanai is based in the United States, and we ship our products worldwide. If you access our website, place an order, or otherwise interact with us from outside the United States, your personal information will be transferred to, processed in, and stored in the United States, where privacy laws may differ from — and may be less protective than — the laws of your home country.
By using our website or placing an order, you understand that your information will be transferred to and processed in the United States as described in this Privacy Policy.
A. European Economic Area, United Kingdom, and Switzerland
If you are located in the EEA, the UK, or Switzerland, the following additional information applies to our processing of your personal data:
Legal bases for processing. We process your personal data on one or more of these legal bases:
- Performance of a contract — to process your order, arrange shipping, and provide customer service
- Consent — for marketing communications and nonessential cookies, which you may withdraw at any time
- Legitimate interests — for purposes such as fraud prevention, website security, and improving our products and services, balanced against your rights and interests
- Legal obligation — for purposes such as tax, accounting, and responding to lawful requests
International transfers. Because Kamanai and most of our service providers (payment processors, hosting, email, analytics, and advertising platforms) are based in the United States, transferring your data outside the EEA/UK involves a transfer to a country that has not received an adequacy decision from the European Commission or UK authorities. Where we or our service providers transfer personal data out of the EEA, UK, or Switzerland, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses (and, for UK transfers, the UK's International Data Transfer Addendum), or another valid transfer mechanism.
Your rights. In addition to the rights described in Section 8, you have the right to lodge a complaint with your local data protection supervisory authority.
EU/UK representative. We do not currently have a physical establishment in the EEA or UK. If required under Article 27 of the GDPR or the equivalent UK GDPR provision, we will appoint an EU or UK representative and update this section with their contact details.
B. Other Jurisdictions
If you are located in a country with its own data-protection law (for example, Canada, Brazil, or elsewhere), that law may give you additional rights beyond those described in this Privacy Policy. We aim to honor reasonable requests consistent with applicable law; contact us using the details in Section 8 or Section 15 to make a request.
C. Customs, Import Duties, and Shipping Data
Because we ship internationally, order information (such as your name, address, and item/value details) may be shared with shipping carriers, customs authorities, and import/export compliance providers as required to deliver your order and comply with customs and trade regulations in the destination country. You are responsible for any import duties, taxes, or customs fees assessed by your country; these are outside our control and are governed by the destination country's regulations.
14. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes to our practices, technologies, services, or legal obligations.
When we update it, we will revise the "Last Updated" date at the top. Material changes may also be communicated through the website or by another appropriate method.
Your continued use of the website after an updated Privacy Policy becomes effective signifies your acknowledgment of the revised policy.
